Welcome to Mappii! These Terms of Service (“Terms”) form a binding agreement between you (“you” or “User”) and Mappii (“we,” “our,” or “us”). By accessing or using any part of the Mappii platform (“Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Eligibility & Account
- You must be at least 13 years old (or the minimum age of digital consent where you live) to create an account. If you are under 18, you may use Mappii only with the involvement of a parent or legal guardian who accepts these Terms on your behalf.
- You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
2. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the revised Terms and update the “Last updated” date above. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
3. User-Generated Content
You retain ownership of the content you submit or display on Mappii (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute your User Content solely for the purpose of operating and improving the Service. You are responsible for ensuring that your User Content complies with all applicable laws and does not infringe the rights of others.
4. Prohibited Conduct
- Posting unlawful, defamatory, or hateful material.
- Uploading malware or attempting to disrupt the Service.
- Scraping, reverse-engineering, or otherwise misusing Mappii without prior written permission.
- Violating any applicable export-control, privacy, or intellectual- property laws.
5. Paid Plans, Billing & Refunds
Paid subscriptions (e.g., Creator Gold) are billed monthly and renew automatically until cancelled. You may cancel at any time in your account settings; fees already charged are non-refundable except where required by law.
6. Intellectual Property
Mappii’s trademarks, logos, and software are our property or that of our licensors. Except for the limited license granted to you to use the Service, we reserve all rights.
7. DMCA Notice & Repeat-Infringer Policy
If you believe content posted on Mappii infringes your copyright, please send a notice to support@mappii.com with the information required under 17 U.S.C. §512(c)(3). We will respond promptly and may remove or disable access to the material and terminate repeat infringers.
8. Privacy
Your use of Mappii is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your personal data.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAPPii SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES.
11. Indemnification
You agree to indemnify and hold harmless Mappii, its affiliates, officers, and employees from any claims or damages arising out of your misuse of the Service or violation of these Terms.
12. Dispute Resolution, Arbitration & Class-Action Waiver
You and Mappii agree to resolve disputes through binding arbitration administered by JAMS under its Streamlined Rules. You waive the right to participate in class actions. The Federal Arbitration Act governs this section.
13. Governing Law
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. The arbitral seat and, if a claim proceeds in court, the exclusive venue shall be the state and federal courts located in Chicago, Illinois.
14. Severability & Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and Mappii regarding the Service and supersede all prior agreements.
